Welcome to Rendezvously!

These Terms of Service ("Terms") govern your access to and use of Rendezvously, our AI-powered dating platform available at https://rendezvously.top ("Service"). By creating an account or using our Service, you agree to be bound by these Terms.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICE.

1. DESCRIPTION OF SERVICE

Rendezvously is an AI-powered dating platform that helps users find meaningful connections through intelligent matching. Our Service includes:

• 20 daily curated matches selected by AI based on compatibility
• Identity verification and Trust Score system
• AI Dating Coach for conversation assistance and profile optimization
• Profile creation with photos, voice recordings, and video content
• Secure messaging with end-to-end encryption
• Weekly analytics and insights
• Optional premium features (Elite Membership, Spotlight Boost)

2. ELIGIBILITY

To use Rendezvously, you must:

• Be at least 18 years of age
• Be legally able to enter into a binding contract
• Not be prohibited from using the Service under applicable laws
• Not have had your account previously terminated by us for violations

By creating an account, you represent and warrant that you meet these requirements.

3. ACCOUNT CREATION AND VERIFICATION

3.1 Registration

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Identity Verification

All users must complete identity verification by:

• Submitting a selfie photo
• Providing a government-issued ID scan

Verification is required to maintain community safety and establish your Trust Score. We use AI and, when necessary, human review to verify identity. Accounts that fail verification or provide fraudulent information will be terminated.

3.3 Profile Content

You agree that your profile information (bio, photos, voice/video recordings) will:

• Be accurate and authentic
• Not contain false, misleading, or deceptive content
• Comply with our Community Guidelines (Section 5)
• Not infringe on intellectual property rights of others

4. TRUST SCORES AND COMMUNITY SAFETY

4.1 Trust Score System

Your Trust Score is calculated based on:

• Identity verification status
• Community behavior and respectful messaging
• Profile authenticity and completeness
• User feedback from dates and interactions

Trust Scores are displayed publicly on your profile to help users make informed decisions about connections.

4.2 Content Moderation

Our AI monitors all content in real-time for:

• Harassment, threats, or abusive behavior
• Scams, fraud, or spam
• Sexually explicit or inappropriate content
• Hate speech or discriminatory language

Violations may result in lowered Trust Scores, warnings, or account termination.

5. ACCEPTABLE USE AND COMMUNITY GUIDELINES

You agree NOT to:

• Impersonate others or create fake profiles
• Harass, threaten, or abuse other users
• Solicit money or financial information from other users
• Share content that is sexually explicit, violent, or illegal
• Use the Service for commercial purposes or spam
• Attempt to manipulate Trust Scores or AI algorithms
• Scrape, collect, or access user data through automated means
• Circumvent identity verification or create multiple accounts
• Share another user's private information without consent

Violations will result in account suspension or termination, and potentially legal action.

6. USER CONTENT AND INTELLECTUAL PROPERTY

6.1 Your Content

You retain ownership of content you submit (photos, bio, voice/video recordings, messages). By submitting content, you grant Rendezvously a worldwide, non-exclusive, royalty-free license to:

• Display your content to other users as part of the Service
• Process your content through AI for matching, moderation, and optimization
• Store and transmit your content securely

6.2 Content Removal

We reserve the right to remove any content that violates these Terms or our Community Guidelines.

6.3 Our Intellectual Property

All Rendezvously branding, logos, AI technology, algorithms, and platform design are owned by us. You may not copy, modify, or create derivative works without written permission.

7. SUBSCRIPTION AND PAYMENT TERMS

7.1 Free Service

Basic features are available at no cost, including:

• Daily curated matches
• Verified profiles and Trust Scores
• Secure messaging
• Basic AI coaching
• Profile insights

7.2 Spotlight Boost (One-Time Purchase)

• Increases your profile visibility for 24 hours
• Non-refundable once activated
• Pricing displayed at time of purchase

7.3 Elite Membership (Monthly Subscription)

Elite Membership includes:

• Advanced AI coaching features
• Priority matching algorithms
• Weekly detailed analytics reports
• Monthly 20-minute session with human dating coach
• Unlimited profile optimization tips
• Advanced conversation insights

Subscriptions automatically renew monthly unless cancelled. You can cancel anytime through your account settings or the Stripe customer portal.

7.4 Payment Processing

Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

7.5 Refund Policy

• Spotlight Boost: No refunds once activated
• Elite Membership: Refunds available within 7 days of initial subscription purchase only. No refunds for renewal charges.
• To request a refund, email bartzalewskidev@gmail.com with "Refund Request" in the subject line.

7.6 Price Changes

We reserve the right to change pricing with 30 days' notice. Changes will not affect existing subscriptions until renewal.

8. AI USAGE AND LIMITATIONS

8.1 AI Features

Our AI provides:

• Match curation based on compatibility analysis
• Conversation starter suggestions
• Bio and profile optimization recommendations
• Photo quality assessment
• Content moderation
• Message translation (Polish/English)

8.2 AI Limitations

AI-generated suggestions are for guidance only. We do not guarantee:

• Specific matching results or dates
• Success in relationships
• Accuracy of all AI recommendations

You are responsible for your own decisions and interactions. Use AI suggestions at your discretion.

9. MESSAGING AND COMMUNICATION

• Messages are encrypted end-to-end for privacy
• You may only message users with whom you have matched
• Unsolicited commercial messages are prohibited
• We reserve the right to monitor messages for safety (see Privacy Policy)

10. THIRD-PARTY SERVICES

Our Service integrates with third-party providers:

• Stripe (payment processing)
• OpenAI (AI features)
• MongoDB Atlas (data storage)
• Resend (email delivery)

Use of these services is subject to their respective terms and policies.

11. DISCLAIMERS AND LIMITATION OF LIABILITY

11.1 "AS IS" Service

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11.2 No Guarantee of Results

We do not guarantee that you will:

• Find a romantic partner or relationship
• Receive a specific number of matches
• Have positive interactions with other users

11.3 User Responsibility

You are responsible for your interactions with other users. Exercise caution and common sense when meeting people in person. We recommend meeting in public places and informing friends or family of your plans.

11.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RENDEZVOUSLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Interactions with other users
• Unauthorized access to your account or content
• Bugs, viruses, or technical malfunctions
• Any third-party content or conduct

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR $100, WHICHEVER IS GREATER.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Rendezvously and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any rights of another user
• Your content or conduct on the Service
• Your violation of any laws or regulations

13. TERMINATION

13.1 By You

You may delete your account at any time through account settings. Upon deletion:

• Your profile will be removed from public view immediately
• Most data will be permanently deleted within 30 days
• Some data may be retained as described in our Privacy Policy

13.2 By Us

We may suspend or terminate your account immediately if you:

• Violate these Terms or Community Guidelines
• Engage in fraudulent or illegal activity
• Threaten the safety of other users
• Create multiple accounts after termination

Terminated users may not create new accounts without our written permission.

14. DISPUTE RESOLUTION

14.1 Informal Resolution

14.2 Arbitration Agreement

Any disputes that cannot be resolved informally shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if they qualify.

14.3 Class Action Waiver

You agree that disputes must be brought on an individual basis only, and not as a plaintiff or class member in any class or representative action.

15. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of Poland, without regard to conflict of law principles. For users outside Poland, local laws may also apply.

16. CHANGES TO TERMS

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Material changes will be communicated via email or in-app notification.

Continued use of the Service after changes constitutes acceptance of the updated Terms.

17. GENERAL PROVISIONS

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rendezvously.

17.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

17.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver.

17.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.
